Game Knights Limited Terms and Conditions

 

These are the terms and conditions subject to which you are able to engage our services and products.

 

This service is operated by Game Knights Limited. Throughout this document, the terms “we”, “us” and “our” refer to Game Knights Limited. Where we refer to “you”, that is you, the customer employing our Services

 

By visiting our site and making a booking with us, you engage in our “Service” and agree to be bound by the following terms and conditions. 

 

Any new services or products which are added will be subject to these Terms and Conditions of service. We reserve the right to update, change or replace any part of these Terms and Conditions of Service.

 

SECTION 1. Definitions

These definitions apply unless the context requires a different interpretation:

 

"Games Hire Package" refers to the physical goods supplied to you, the customer for the agreed hire period by us and includes all games, packaging, rules, components, bags, boxes and all other associated items provided by us

 

“Hire Period” refers to the period of time we have agreed for you to have use of our Games Hire Package. The package remains the property of Game Knights Limited and you are not permitted to sub-hire any part of the package to a 3rd party.

 

“Learn-to-play Session or Event” refers to our service which you have booked. A date, time and venue will be agreed upon by you and us in advance. Any changes made to this will be subject to our change or cancelation policy.


 

Section 2. Conditions of Hire and Booking of Learn-to-play Sessions and Events.

 

2.1. Rates for Games Hire Packages 

The hire rates depend on the package selected and the length of the hire period. Please refer to the “Offer of Service” and remain valid for the period of time stipulated in the offer of service only. Game Knights Limited reserves the right to change and amend our packages, services and prices until the Offer of Service has been accepted by you.

 

2.2. Payment options for Games Hire Packages 

Bank Transfer - We accept payment via bank transfer when you have been provided with an invoice. Please use your invoice number as a reference. Full payment needs to be received before the agreed delivery date of your Games Hire Package. 

Eftpos/Credit Card - By prior arrangement we can also accept payment by valid eftpos/credit cards at the time of delivery.

 

2.3. Rates for Learn-to-play Sessions and Events

Rates for the Hosted Sessions and Events are set out in the “Offer of Service” and remain valid for the period of time stipulated in the offer of service only. Game Knights Limited reserves the right to change and amend our packages, services and prices until the Offer of Service has been accepted by you.

 

2.4. Payment Options for Learn-to-play Sessions and Events

Bank Transfer - We accept payment via bank transfer when you have been provided with an invoice. Please use your invoice number as a reference. Payment needs to be received by us Within 7 days of you receiving the invoice from and before the Day of the event if this is sooner than 7 days.


2.5. Returns/Collection/Extending the hire period

Depending on the length of your hire period, you will be given a date and time for the collection of the Game Hire Package. All games must be packed up, complete and undamaged ready for the collection. 

If you wish to extend the hire period, this needs to be requested no later than 48hours before the original return date. Depending on availability, the Games Hire Package may be extended as requested and a new collection date and time will be agreed. You will be sent an invoice for the new period of hire. This will need to be paid within 48 hours of receipt of the invoice. Failure to pay the invoice on time may result in the extended hire period being revoked and the Games Hire Package being collected.

 

2.6. “1 week hire” refers to 7 consecutive days. 

For example; if your Games Hire package is booked for delivery on Monday morning, you can expect the collection to return the package to be arranged for the following Monday morning.

 

2.7. Extensions to the hire period are treated as new hire agreements and therefore are charged at the full price of the requested hire period. 

For example; If your original hire period was for 1 week and 48 hours before the planned collection to return the package, you request to extend the hire period for 1 week, subject to availability you will be invoiced for another 1 week hire fee.

 

2.8. Rentals are discounted for pre-booked longer periods of hire.

 For example; If your original booking is for the 2 week hire of the Silver Package, you will have to pay less than if you booked a 1 week hire which you then extended.  1 week hire $50 + 1 week hire $50= 2 weeks hire total $100 inc GST.  2 week hire $80 inc GST(price examples given above are for demonstration purposes only and are subject to change)

 

2.9. Care expectations

By entering into the Hire Agreement you, the Customer, agree to provide proper care of all games hired and to return all games and associated supplied items in the same condition as they were when received. Responsibility of care remains with the customer from the time of receipt to return. Please be sure all game equipment is accounted for at all times and protected from events that could cause loss or damage.

 

2.10. Lost, Damaged or Incomplete games and property

In the event that any Game or other supplied Game Knights Ltd property is lost, stolen, damaged or found to be incomplete on return, you are responsible for paying the full retail price of replacement. In the first instance we will endeavour to order replacement parts from the manufacturer. You will be responsible for any cost associated with this. If replacement game components are unavailable the game is likely to be rendered unusable. In this situation the replacement of the game will be necessary and you will be responsible for this expense. You, the Customer will be notified and given 7 days to locate and return to us any missing parts. If you fail to locate the missing parts or they are returned to us in a damaged state, you will be invoiced for the full retail replacement cost. Payment of this invoice must be made to Game Knights Ltd within 7 days of receipt. Late fees may apply.

 

2.11. Non contactable customers

If the Games Hire Package is not returned as per the agreement for any reason, Game Knights Ltd reserves the right to pursue and reclaim all of its property that was hired and any money owed through all avenues of legal means. Any cost that Games Knights Ltd incurs during this process will be on charged to the customer.

 

Section 3. Cancellation Policy and Changes

 

3.1. Cancellation of Hosted Sessions or Events

We need to be notified of a cancellation in writing. This can be done by emailing info@gameknights.co.nz

The following timeframes for cancellations determine the refund possible;

More than 2 weeks before the booking, you will be offered one opportunity to reschedule. If you do not wish to reschedule then a full refund of the money paid for the cancelled booking can be requested.

Less than 2 weeks but more than 48 hours before the booking, you will be offered one opportunity to reschedule. If you do not wish to reschedule then 50% of the money paid for the cancelled booking can be requested.

Less than 48 hours before the booking, you will be offered one opportunity to reschedule. If you do not wish to reschedule, we will retain the money already paid for the booking and no refund will be offered. (see the exception to this in section 3.2)

 

3.2. Cancellations due to Covid 19 restrictions

If the booked Learn-to-play Session or Event is unable to take place due Covid 19 restrictions, you will be offered one opportunity to reschedule. If you do not wish to reschedule then a full refund of the money paid for the cancelled booking can be requested.

 

3.3. Cancellation of Games Hire Packages without a Hosted session.

More than 48hours before the arranged delivery date and time of the Games Hire Package. You can cancel without incurring any fees. If you have already made payment for the Games Hire Package you wish to cancel, you will be offered the opportunity to reschedule. If you do not wish to reschedule, a full refund can be requested.

Less than 48 hours before the arranged delivery date and time of the Games Hire Package. You will be offered one opportunity to reschedule. If you do not wish to reschedule a 50% refund of any money already paid for the Hire booking can be requested. If you have made arrangements to pay on delivery but then cancel with less than 48 hours notice, you will be invoiced for 50% of the cancelled Games Hire Package fee.

 

SECTION 4. Termination

​This agreement terminates on the first to happen of the following events:

4.1. at the expiry of a fixed Hire Period set out in the Invoice, or any extension of it;

 

4.2. we give you notice that we are terminating the agreement because you are, or might be, in breach of this agreement, including a failure to make payment of Charges when due.

 

SECTION 5. You indemnify us

You agree to indemnify us against all costs, claims and expense arising directly or indirectly from:

5.1. your failure to comply with the law;

 

5.2. your breach of this agreement;

 

5.3. a contractual claim arising from your use of the Equipment or the Services.


Section 6. Offer of Service for Learn-to-play Sessions or Events and Agreement.

By accepting our Offer of Service and paying the invoice you receive from us for your booking, you are agreeing to the Terms and Conditions above.

 

Section 7. Games Hire Packages Agreement.

By booking a Games Hire Package with us you are agreeing to the Terms and Conditions above.
